CREDIT PURCHASES:

1. Purchased credits may represent displays of the advertiser's advertisements either as a top ad (text and image), OR bottom ad (text only). The type of advertisement credits will be utilized for will be selected randomly by the LeadWhiz software.

2. Following successful payment, due credits will be deposited into the client's account which will be considered full and complete delivery of the required services, thus fulfilling all obligations of Site Promotions PTY LTD. This shall be effective providing the LeadWhiz service remains operational.

3. Site Promotions PTY LTD does not guarantee the rate at which credits will be depleted or utilized in exchange for impressions/displays of the advertiser's advertisements. The advertiser accepts any rate of delivery which shall be automated by the LeadWhiz software.

4. Refunds are not permitted once the credits have begun to be utilized/depleted, and/or exchanged for views of the advertiser's advertisements. In the event of technical difficulties directly related to software operated by Site Promotions PTY LTD that results in the loss of purchased credits, receipt of payment for the advertising must be provided by the advertiser for credits to be replaced.

5. Site Promotions PTY LTD does not make any representations, guarantees or warranties with respect to the actual success or effectiveness of advertising purchased via LeadWhiz. The advertiser agrees to accept all responsibility and liability for any losses incurred as a result of purchased advertising. In no event shall Site Promotions PTY LTD be liable for any losses, any direct or indirect, special, incidental or consequential damages of any kind or nature. Site Promotions PTY LTD disclaims all warranties and liability of any kind, whether express, implied or otherwise.

6. If images/advertisements are hosted by the advertiser, Site Promotions PTY LTD is not responsible for any server downtimes, and therefore is not liable to replace credits that have been used during such server downtimes.

LEAD PURCHASES:

1. Following the advertiser's submission of payment for any lead purchase, Site Promotions PTY LTD will agree with the advertiser on actual advertisements used to generate leads. Any unauthorized change of advertisements is not permitted. Site Promotions PTY LTD will continuously monitor the advertiser's promotion and add credits to the advertiser's account until the required lead quota is met.

2. Site Promotions PTY LTD makes no guarantees with respect to the rate of delivery and/or generation of leads. Advertiser agrees that once advertisements begin rotation, the promotion will continue until all leads have been generated, irrespective of the rate of delivery. If the average daily lead volume is considered too low by either the advertiser or Site Promotions PTY LTD, both parties may mutually agree to modify the advertisements. The creative material may be modified at any time providing both parties mutually agree to do so.

3. Site Promotions PTY LTD does not make any representations, guarantees or warranties with respect to the actual success or effectiveness of advertising purchased via LeadWhiz. The advertiser agrees to accept all responsibility and liability for any losses incurred as a result of purchased advertising. In no event shall Site Promotions PTY LTD be liable for any losses, any direct or indirect, special, incidental or consequential damages of any kind or nature. Site Promotions PTD LTD disclaims all warranties and liability of any kind, whether express, implied or otherwise.

ACCOUNT UPGRADES:

1. Site Promotions PTY LTD does not make any representations, guarantees or warranties with respect to the actual success or effectiveness of LeadWhiz account upgrades. The client agrees to accept all responsibility and liability for any losses incurred as a result of account upgrades. In no event shall Site Promotions PTY LTD be liable for any losses, any direct or indirect, special, incidental or consequential damages of any kind or nature. Site Promotions PTY LTD disclaims all warranties and liability of any kind, whether express, implied or otherwise.

2. Following successful payment, due features will be enabled for the member's account for a minimum of one month. By defintion, this will be considered full delivery of the required services, thus fulfilling all obligations of Site Promotions PTY LTD.

3. Following successful payment and upgrading of the advertiser's account, refunds are not permitted. Members are automatically billed monthly until they cancel their subscription by notifying LeadWhiz administration staff at least 3 days prior to the next billing period.
